§ 1 Provider and scope

Hereinafter “we”, “us” or “Ombre & Feu”. Our offer is addressed to both consumers and businesses, with certain provisions applying expressly only to consumers or only to businesses.
These terms and conditions apply to all orders you place through our online shop ombrefeu.de, which is operated on Shopify. The version valid at the time of the order applies. We object to any deviating terms of the customer; they only become part of the contract if we expressly agree to them in writing.
A consumer is any natural person who enters into a legal transaction for purposes which are predominantly outside their trade, business or profession. A business is a natural or legal person or a partnership with legal capacity that, when entering into the legal transaction, acts in the exercise of its trade, business or profession.
§ 2 Contract language and contract text
The contract is concluded in German. We store the contract text and send you the order details together with these terms and conditions by email. You can view and download the terms and conditions on this page at any time. If you have created a customer account, you can view your past orders there.
§ 3 Account and access credentials
You may need a customer account to use certain functions. You warrant that all data you provide is accurate and complete, and you undertake to keep it up to date. You are responsible for keeping your access credentials confidential and are liable for activities carried out via your account insofar as you are responsible for them.
§ 4 Our products and their presentation
We endeavour to present our products as accurately as possible in images and text. Technically unavoidable deviations in colour and presentation are possible and do not constitute a defect. The respective product description is decisive for the characteristics of the product. Fragrance descriptions are subjective; the perception of a perfume can vary depending on skin type and environment.
§ 5 Conclusion of contract
The presentation of products in the online shop does not constitute a legally binding offer, but a non-binding invitation to order goods. By submitting your order via the “Buy now” button you make a binding offer to purchase.
Receipt of your order is first confirmed automatically by email (acknowledgement of receipt). This does not yet constitute acceptance of the contractual offer. The purchase contract is only concluded when we accept your offer by means of a separate order confirmation or when we dispatch the goods.
We reserve the right not to accept an order (e.g. in the event of unavailability or obvious errors in price or description). In this case we will inform you without delay and refund any payments already made.
§ 6 Prices and payment
The prices stated in the shop at the time of the order apply. All prices are final prices and include statutory VAT, currently 19 %. Shipping within Germany is free of charge.
Payment is made using the payment methods offered in the shop. If paying by credit card, you warrant that you are authorised to use the card provided. If you default on a payment, the statutory provisions apply.
§ 7 Shipping, delivery and passing of risk
We deliver within Germany. Delivery usually takes 2–4 business days after the contract is concluded; you will find the details on the Shipping and payment page. Unless expressly designated as binding, stated delivery times are non-binding estimates. We are not liable for delays caused by force majeure or by the shipping service provider and for which we are not responsible; your statutory rights remain unaffected.
Passing of risk: If you are a business, the risk of accidental loss and accidental deterioration of the goods passes to you upon handover to the shipping service provider. If you are a consumer, the risk only passes upon handover of the goods to you (or to a person authorised by you to receive them).
§ 8 Retention of title
The goods delivered remain our property until the purchase price has been paid in full.
§ 9 Right of withdrawal
As a consumer you have a statutory right of withdrawal. You will find the details, the conditions, the exceptions (in particular for sealed perfumes whose seal has been removed) and the model withdrawal form in our separate right of withdrawal notice.
§ 10 Warranty (liability for defects)
The statutory provisions on liability for defects apply. For consumers, the limitation period for newly manufactured goods is two years from receipt of the goods.
For businesses the following applies by way of derogation: the limitation period for claims based on defects is one year from the passing of risk; the statutory obligations to inspect and give notice of defects (section 377 of the German Commercial Code) remain unaffected. This reduction does not apply in cases of intent, gross negligence, injury to life, body or health, or claims under the German Product Liability Act.
If the goods delivered are defective or you received the wrong item, please contact us immediately at bestellungen@ombrefeu.de. In these cases we bear the cost of return.
§ 11 Liability
We are liable to you without limitation in cases of intent and gross negligence, for culpable injury to life, body or health, under the provisions of the German Product Liability Act and to the extent of any guarantee we have given.
In the event of slightly negligent breach of a material contractual obligation, our liability is limited to the foreseeable damage typical of the contract. Liability is otherwise excluded.
§ 12 Notes on use
Please observe the instructions for use and safety notes on the packaging and in the product description. Perfumes contain alcohol: do not spray into the eyes, keep away from flames and sources of heat, and store out of the reach of children. Discontinue use in the event of skin irritation. The ingredients (INCI) are listed on the packaging.
§ 13 Intellectual property
All content of our shop – in particular texts, images, graphics, logos, trade marks and their arrangement – is protected by copyright or trade mark law. It may be used exclusively for your personal, non-commercial purposes.
§ 14 Customer reviews and submitted content
If you voluntarily submit content (e.g. reviews, comments, images), you grant us a simple, royalty-free right to use this content to operate and promote the shop. You warrant that you hold the necessary rights. We may remove unlawful, insulting or offensive content.
§ 15 External links and third-party tools
Our shop may contain links to external websites as well as embedded third-party tools over whose content we have no influence. The respective provider is responsible for this content.
§ 16 Relationship with Shopify
Ombre & Feu Fragrance is operated on Shopify. All sales and purchases you make in our shop are made directly with Ombre & Feu Fragrance. Shopify is not responsible for any aspect of sales between you and us.
§ 17 Data protection
Information on the processing of your personal data can be found in our privacy policy.
§ 18 Permitted use
You may use the shop only for lawful purposes. In particular, unlawful acts, the introduction of malware, the automated extraction of content (scraping), the circumvention of security measures and any use that impairs the operation of the shop or other users are prohibited.
§ 19 Consumer dispute resolution
We are neither willing nor obliged to participate in dispute resolution proceedings before a consumer arbitration body.
§ 20 Final provisions
Applicable law: The law of the Federal Republic of Germany applies, excluding the UN Convention on Contracts for the International Sale of Goods (CISG). If you are a consumer habitually resident in another EU member state, the mandatory consumer protection provisions of your state of residence remain unaffected.
Place of jurisdiction: If the customer is a merchant, a legal person under public law or a special fund under public law, or has no general place of jurisdiction in Germany, the exclusive place of jurisdiction for all disputes arising from this contract is our registered place of business. In relation to consumers, the statutory places of jurisdiction apply.
Severability: Should any provision of these terms and conditions be or become invalid, the validity of the remaining provisions remains unaffected.
